UPDATE:
Today was our hearing (via video conference) on our Motion for Preliminary Injunction. As the State filed a Motion for Summary Judgment, it was heard on calendar today as well.
Unfortunately, our Motion was denied. The State's Motion was granted.
To sum it up, the State got away with doing what they wanted with no accountability.
To clarify ~ we were not evicted. The terms of the previously named "eviction" were thrown out early on in court when we proved the false 3 contention points the State threw at us and tried to get the public to believe. #1) No Insurance. We provided proof of insurance for the last 20 years. #2) Environmental Issues. We provided proof of passing State's inspection. #3) Unauthorized Space. We proved our case on the terms of the ramp space. After providing proof of compliance, the State then turned this into a matter of "we just don't want you here because we are redeveloping JRF (Kalaeloa Airport) and we need the space you are occupying".
Through the thick and thin of this whole case, it turned into a simple "they are the landlords - you are the tenants", therefore, they can do what they want because there is a 30 day revocable permit. (Which is like a contract/lease which most tenants on the airport get).
So..... although the Judge (who's very own father was in the 442!) seemed to be on our side and sympathetic early on, somewhere along the line, couldn't justify why we would get to stay where a "landlord" wanted their space back. He couldn't find where "the law" was favorable to us.
While most "tenants" would get 30 days to remove property and leave, we fought hard for longer time. We were able to get 90 days. 90 days to wrap up 20 years of history. How mighty nice of the State DOT-A. We know that nothing will take our place for a long time to come. Who would want to fall under the unfair rules of the State DOT-A?
At this time, we are going to do our best to make other arrangements to protect our artifacts, gear, equipment and aircraft. This precious historical collection will not be destroyed under our watch and will not be treated as boxed up garbage. We won't let it.
For now, NAMBP is still an entity. They cannot take that away from us. Until we decide to close up shop & dissolve our Board and entity, we still exist. Even beyond the 90 days.
This has been an extremely difficult situation. We are heartbroken and absolutely disgusted with the outcome today. We want to humbly thank all of you for everything you have done over the 20 years and during this situation, to support us. You are what kept us going. All of you.
Please know that we are doing what we can to keep the memory of the former NAS Barbers Point alive. Our Veterans who have sacrificed their lives for our very freedom will not be forgotten, nor will all the Veterans, Military, civilians, etc. Everyone counts.
We will keep you all informed as things move along. We are sorry to have to share this unhappy news.
