Thank you to everyone who supported us and wrote in to Charnwood planning department objecting to the proposed road junction opposite our entrance. The consultation period finished yesterday so we await the outcome, fingers crossed this time they have listened.

Update on planning application opposite us P/22/2223/2, the planners have granted another extension of time until the 31st December 2024 !! this is after they granted an extension of time from Nov 23 until 31st July 24 with no new information coming forward. !!!!

We have had one or two requested regarding watermill open days this year. Unfortunately as the planning application P/22/2223/2 is still on going and we don't know the outcome or a decion date we cannot plan for our open days, so we have taken the decion to not open this year 🥲. Once we have a clear decision on the planning application we will advise you if we are to reopen. Please support our history and email Charnwood Borough Council on [email protected] ref: P/22/2223/2 objecting to the impact the proposed junction has on our watermill, livery yard business and Grade 2 status.

List of objections to P/22/2223/2:

1. Impact the location of the road junction on the livery yard business would make it unsafe for horse riders and motorist, this would force the closure of a rural business. This is again local and national policy NPPF paragrapgh 187.

1.a The location of the junction would create a high risk accident spot when entering or exiting the watermill open days, this would force the closure of Shepshed Watermill which has been open to the public since 2000 (23 years).

2. Noise and light polution impact on a grade 2 listed building and livery yard business.

3. No up to date heritage statement and fails local policy CS14

4. No light impact assessment give Mill Farm has teh presents of BATS this is recommended in our own PEA by Julian Jones Ecology Services.

5. Given the proximity of the junction to the mill pond and bats etc. no site-specific ecological assessment has been carried out as to the effect it will have on the biodiversity at Mill Farm.

6. Millward Drawing’s 2112 & s278 100 G show works to the Town brook which are outside red line boundary or S278 works boundary. They also fail to show works required to the hedge again outside the redline on Hathern Road to be able to build the path, This is not allowed as it would set a president for future applications.

7. Millward Drawing 1010 shows the road will be closed to the public, this has only just been upload on to the portal and has a wider impact on the local community as the recycling centre will be closed this requires a public consultation period.

8. Noise impact assessment and data incorrect, this has been highlighted to the planner and EHO by a third-party acoustic company. They are using data from Wortley Close which is a 30mph road with no HGVs as the source for Mill Farm which is a 40mph and has HGV traffic.

9. EHO’s change of mind to accept no lorry movement at night is not enforceable. This still does not change the predicted noise levels at Mill farm and fails to meet WHO standards.

10. Pegasus crossing viability report – no consultation with livery yard business and report completely made up of incorrect data and pure speculation. This can be confirmed by the number of local horse riders submissions online.

11. The obtained Road safety audit highlights concerns for Horse riders, now that the Pegasus crossing has been removed, and the fact that Mill Farm Liveries is a business the road safety audit is flawed and requires a new audit.

12. Original officers report - 9.4.5 Factually wrong, CBC licencing department have confirmed we have event notices for our open day, Mill Farm Liveries has been paying business rates for over 20 years to CBC, based on this information it brings into question the whole principals of the officers report and thus this application should be rejected.

13. Original officers report - the approved plans have the incorrect revision and have been superseded, thus no one knows what is the leasted versions we should be looking at.

Below are a number of errors in the decision notice:

Condition 2,

Key Planning Layout (MA11509-SP4-1004 B) Wrong revision should have been 1004C. 1004B includes the Pegasus crossing which has been removed, LCC Highways consultee removed their objection based on no Pegasus crossing.

Drainage Layout (MA11509-SP4-2004 B) doesn’t exist on the portal, so no public or statutory consultation has been carried out

Drainage Layout (MA11509-SP4-2001 A) Wrong revision should have been 2001B. 2001A includes Pegasus crossing on plan

Planning Layout (MA11509-SP4-1001A) Wrong revision should have been 1001B. 1001A includes Pegasus crossing on plan

14. Application also fails NPPF 189, 190, 194, 195, 199, 200, 201

15. No vehicle tracking done on the junction following a request to show lorries turning right would safely be able to do so without dirving over verge of centre island.

16. Original approval notice -

Condition 3,
The Hathern Link Road shall not be opened to public traffic until its junction with Hathern Road shown on MCE drawing number MA11509/S278/HRJ/100 Revision H has been implemented in full. This condition fails to comply with condition 46 of the outline scheme P/14/1833/2 (See below)

Condition 46. Access to Leicestershire County Council Civic Amenity Site, shall not be restricted
at any time during the construction of the development.
REASON: To protect the operations of the domestic Civic Amenity facility

Condition 4,
The Hathern Link Road's junction with Hathern Road shall not be opened to traffic until such time as vehicular visibility splays of 4.5 metres by 130.66m and 119.72m have been provided to the left and right respectively. These shall thereafter be permanently maintained with nothing within those splays higher than 0.6 metres above the level of the adjacent footway / verge / highway. This condition fails to comply with condition 46 of the outline scheme P/14/1833/2

Condition 5,
The Hathern Link Road (between Hathern Road and the Garendon Strategic Link Road, as shown on MA11509/1010 received 21/07/2023) shall not be opened to public traffic until it has been fully constructed in accordance with MCE drawings numbers MA11509/SP4/1001 Revision B and MA11509/SP4/1002 Revision B. This condition fails to comply with condition 46 of the outline scheme P/14/1833/2, also revision B is not an approved drawing see condition 2

BAD NEWS!!!
The planning application for the road opposite the watermill P/22/2223/2, the applicant are NOT changing anything and thus relying on CBC plans committee and LCC Highways to pass this application, even though the officer mislead the committee and the application is in breach of CBC local planning policies and national planning policy.
Therefore please write in again to [email protected] with your objects to this proposal as it impact an exist business which would result in the closure and also prevent the local community being able to attend our Shepshed Watermill open days.

Quick update on the road opposite planning application P/22/2223/2. The high court approved our appeal on 22nd November 2023 and we have just received the paperwork, so now we have to see what changes will be made to the application before it goes in front of Charnwood BC planning committee.

P/22/2223/2 objection emails, please wait until the high court has quashed the decision notice. Then the application will be live again and depending on any changes thats the time to submit your emails.

Planning application
P/22/2223/2 update:

We appointed Richard Buxton Solicitors and a Barrister to start proceedings of a judicial review against Charnwood Borough Council. The council have accepted our claim and will not defend it, they have agreed to take the corrective actions to quash the decision notice.

This means that we are back to the position prior to the committee meeting, however they need to take into account the livery yard business and the commercial use of the site and it not just being a residential property.

We need your support more than ever if you want the watermill to remain open. Once we have an update later this week or early next week we need you to write in to development control.

Also write to Shepshed Town Council & Hathern Parish Council requesting they object to the application as statutory consultees.
